Terms of Service

These Terms of Service (“Terms”) govern a restaurant's access to and use of the Mygodly storefront, ordering, and marketing platform, websites, and applications (collectively, the “Service”), operated by MYGODLY ECOMMERCE AND TRANSPORTATION INDIA PRIVATE LIMITED. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

In short: You must be an adult authorized to act for your restaurant, keep your account details accurate and your login secure, and tell us if someone else gets into your account.

You must be at least 18 years old, or the age of majority in your jurisdiction, and authorized to act on behalf of the restaurant you register, to use the Service. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your account. Notify us promptly of any unauthorized use.

2. The Service

In short: Mygodly gives your restaurant a storefront for orders and reservations, WhatsApp ordering, and AI-assisted marketing content — features may change or depend on outside providers.

Mygodly lets a restaurant create and publish a storefront, take pickup, delivery, and dine-in orders and reservations, communicate with diners over WhatsApp, manage a catalog/menu, and use AI-assisted content generation for marketing. We may add, change, or remove features over time. Some features depend on third-party providers — including payment processing and WhatsApp messaging — and may change with them.

3. Your content

In short: You own your menu, photos, and catalog; we get a license to host, process, and display them to run and improve the Service, and you're responsible for them being lawful and yours to share.

You retain ownership of the content you submit, including your menu, dish photos, prices, and branding (“Your Content”). You grant Mygodly a worldwide, non-exclusive license to host, store, process, and display Your Content solely to operate and improve the Service, including generating marketing content from it as described in our Privacy Policy. You are responsible for Your Content and represent that you have the rights to it and that it does not infringe others' rights or violate any law.

4. AI-generated content

In short: AI-written captions and enhanced photos can be inaccurate — review before you publish, and the WhatsApp Concierge only quotes real prices from your live menu.

The Service uses AI to help generate captions, posts, and enhanced dish photos, and to power a WhatsApp assistant (“Concierge”) that answers diner questions, takes orders, and books tables. AI output may be inaccurate; you are responsible for reviewing and approving it before it is published at a level of autonomy you have not yet enabled for that action. The Concierge is designed to quote only live prices from your actual catalog and to hand off to a human on anger, complaint, or any mention of an allergy — but you remain responsible for monitoring conversations with your diners.

5. Orders and your diners

In short: You are responsible for fulfilling orders and reservations placed through your storefront — we provide the platform; you run the kitchen.

Orders and reservations placed through your storefront are between you and your diner. You are responsible for accepting, preparing, and fulfilling orders (pickup or your own delivery riders), honoring reservations, and complying with applicable food-safety and consumer-protection law. We provide the platform, payment routing, and diner communication tools described in these Terms; we do not prepare, deliver, or guarantee your food.

6. Acceptable use

In short: Don't use the Service to publish false or harmful content, misrepresent your food, spam diners, disrupt the Service, or impersonate anyone — violations can lead to suspension or termination.

You agree not to use the Service to publish unlawful, deceptive, infringing, or harmful content; to misrepresent your dishes, prices, or availability; to send unsolicited messages to diners who have not opened a conversation with you; to reverse engineer or disrupt the Service; or to impersonate any person or entity. We may suspend or terminate accounts that violate these Terms.

7. Plans, billing & take-rate

In short: Subscriptions renew automatically; we also take 2% on pickup/delivery orders through your storefront (0% on dine-in and reservations); see our Refund Policy for cancellation terms.

Paid subscriptions are billed in advance on a recurring monthly basis. In addition to the subscription, Mygodly retains 2% of the order value on pickup and delivery orders placed through your storefront, and 0% on dine-in orders and reservations, deducted at settlement alongside the payment processor's own fee. Fees are processed by our payment provider. You may cancel your subscription at any time; changes take effect as described in our Refund & Cancellation Policy. Applicable taxes apply.

8. Termination

In short: You can stop using the Service and close your account anytime; we can suspend or end yours for breaching these Terms or to protect the Service.

On termination, your right to use the Service ends; certain provisions survive, including your obligations for orders already placed.

9. Disclaimers & limitation of liability

In short: The Service is provided “as is”, and our liability is capped at what you've paid us in the past twelve months.

The Service is provided “as is” without warranties of any kind, to the fullest extent permitted by law. Mygodly is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid for the Service in the twelve months preceding the claim. This does not limit liability that cannot be limited under applicable law.

10. Changes to these Terms

In short: We may update these Terms and will communicate material changes; using the Service after that means you accept them.

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
